Store terms and conditions

§1. General provisions

  1. These terms and conditions define the rules for using the online store run by THE SIGN Daniel Dziubczyński with its registered office in Opole, ul. Ludowa 47, 45-820 Opole, NIP: 7542725499, REGON: 160102512, entered into the Central Register and Information on Economic Activity (CEIDG) (hereinafter: "Seller"), available at storethesign24.com (hereinafter: "Store").
  2. Contact with the Seller: tel. +48 606 628 444, e-mail: thesignopole@gmail.com.
  3. The Store sells workwear, high-visibility clothing, and health and safety (OSH) products aimed at entrepreneurs (B2B sales).
  4. Use of the Store constitutes acceptance of these terms and conditions.
  5. To use the Store, a device with internet access, an up-to-date web browser, and an active email account are required.

§2. Customer account

  1. Creating an account requires providing company details (name, NIP, address), contact person details, as well as an email address and password.
  2. The Seller may verify the registration details before activating the account, in particular the entrepreneur status.
  3. The Customer undertakes to provide true data and to update it, as well as to keep the password confidential.
  4. Some information, including prices, may be visible only after logging in.

§3. Orders and conclusion of the contract

  1. Orders can be placed via the Store's shopping cart, the quote request form, email, or by phone.
  2. A quote request is not an order — the Seller prepares an individual offer (including price, delivery date, and terms), which becomes binding upon its acceptance by the Customer.
  3. The sales contract is concluded upon confirmation of the order acceptance for processing by the Seller, sent to the Customer's email address.
  4. The Seller may refuse to process an order, in particular in the event of product unavailability, incorrect order details, or non-payment of previous orders.
  5. Information on the Store's website, including product photos and descriptions, does not constitute an offer within the meaning of the Civil Code, but an invitation to conclude a contract.

§4. Prices and payments

  1. Prices specified in the Store are net prices — VAT is added to the prices at the rate applicable on the day of sale.
  2. The Seller reserves the right to change prices, introduce promotions, and establish individual pricing terms for regular Customers. A price change does not apply to already confirmed orders.
  3. Payment is made by bank transfer to the bank account specified in the order confirmation or on the invoice, within the period specified in these documents. The Seller may make the processing of the order conditional on prepayment.
  4. The goods remain the property of the Seller until the full price is paid (retention of title, Art. 589 of the Civil Code).

§5. Delivery

  1. The order processing time is indicated in each case in the order confirmation and depends, among other things, on the availability of the goods and branding.
  2. Delivery costs are determined upon order confirmation, depending on the size and place of delivery.
  3. The risk of accidental loss of or damage to the goods passes to the Customer upon handing over the goods to the carrier.
  4. The Customer should inspect the shipment upon receipt; transport damage must be reported to the carrier and the Seller immediately, at the latest within 3 working days. This recommendation does not exclude or limit the Customer's rights under the warranty for defects.

§6. Branding and personalization

  1. At the Customer's request, clothing may be branded (embroidery, print, heat transfer) according to a design approved by the Customer.
  2. Branding processing begins after the Customer's written approval of the visualization.
  3. Personalized products (made to the Customer's specifications, including branding) are not subject to return or exchange (Art. 38 point 3 of the Consumer Rights Act), except for complaints regarding defects.

§7. Complaints

  1. Complaints regarding product defects or non-compliance with the order should be submitted by email to thesignopole@gmail.com, stating the order number, description of the defect, and — where possible — photos.
  2. The Seller shall consider the complaint within 14 days of its receipt and inform the Customer of the method of resolution.
  3. If the complaint is accepted, the Seller, at its choice or in agreement with the Customer, repairs or replaces the goods, reduces the price, or accepts the return and refunds the amount paid.
  4. The Seller's liability under the warranty for defects is not excluded or limited (the parties do not exercise the right under Art. 558 § 1 of the Civil Code); complaints are considered on the basis of the Civil Code.

§8. Withdrawal from the contract

  1. The right to withdraw from a distance contract within 14 days is granted to consumers. Due to the nature of the Store (B2B sales), this right, as a rule, does not apply to Customers who are entrepreneurs.
  2. However, the right of withdrawal is retained by an entrepreneur entered into the CEIDG, if the purchase is not of a professional nature for them, resulting in particular from the subject of their economic activity (Art. 7aa of the Consumer Rights Act). In such a case, the provisions on withdrawal from the contract by a consumer apply accordingly.
  3. In other, individual cases, the Seller may agree to the return or exchange of non-personalized goods in an unaltered state — the terms must be agreed upon in each case.

§9. Personal data

  1. The rules for processing personal data are described in the Privacy Policy.
  2. The data controller is the Seller.

§10. Intellectual property

  1. Photos, descriptions, and trademarks of manufacturers (including Portwest, Sir Safety, Engel) are the property of their respective owners and are used with the consent of the manufacturers for sales purposes.
  2. Copying the content of the Store outside of permitted use and for the purpose of presenting the offer to one's own customers requires the consent of the Seller.

§11. Final provisions

  1. In matters not regulated by these terms and conditions, the provisions of Polish law shall apply, in particular the Civil Code.
  2. Disputes arising from contracts concluded with entrepreneurs shall be resolved by the court competent for the registered office of the Seller. This provision does not apply to consumers or entrepreneurs referred to in §8 section 2 — in their case, the jurisdiction of the court is determined by the provisions of law.
  3. The Seller reserves the right to amend the terms and conditions. Orders placed before the amendment are processed under the existing rules.
  4. The terms and conditions shall enter into force on the day of publication.
